This document defines the basic terms of business applied by Shark Global d.o.o. Bijeljina (hereinafter referred to as the Company) to all Clients when establishing a business relationship, communication, and providing services in the market.

 

The General Terms of Business prescribe the standard business terms applied to all Clients.

 

The document is intended for all organizational parts of the Company involved in the processes related to the Company-Client relationship.

 

Within the General Terms of Business, certain terms have the following meanings:

 

• Client: Any legal or natural person who has entered into a business relationship with the Company for further sale of the Company's digital product called "Stars," identified by the Company, whether resident or non-resident. A Client becomes such upon entering a business relationship with the Company.
• Business Entity: A Client engaged in a business activity registered with the competent authorities in the country or abroad, in accordance with the applicable regulations.
• Residents (Business Entities): Legal entities registered in Bosnia and Herzegovina, except for foreign legal entities' branches registered in Bosnia and Herzegovina.
• Residents (Natural Persons): Individuals residing in Bosnia and Herzegovina, except those whose temporary residence abroad exceeds one year; foreign nationals residing in Bosnia and Herzegovina based on a residence or work visa for 183 days or more, excluding those employed in diplomatic missions.
• Non-residents (Business Entities): Legal entities registered outside Bosnia and Herzegovina.
• Non-residents (Natural Persons): Citizens of Bosnia and Herzegovina residing abroad for one year or more, foreign nationals residing in Bosnia and Herzegovina up to 183 days, diplomatic missions, etc.
• Domestic Currency: Convertible Mark (KM) as the legal means of payment in Bosnia and Herzegovina.
• Foreign Means of Payment: Foreign currency and cash.
• "Stars": A digital product created and developed by the Company, with all intellectual property rights held by the Company, sold through Clients.

 

 

 

 

 

The General Terms of Business are an integral part of any business relationship established between the Company and the Client. The Company is obliged to apply, and the Client to respect, these terms. Business relationships can be established through written agreements, online forms, or without a written agreement where applicable by law and the Company's regulations.

 

Individual agreements between the Client and the Company take precedence over these General Terms.

 

 

Obligations and Rights of the Company:

 

• The Company must act with due care and professionalism, adhering to principles of good faith and fairness.
• The Company must pay commissions for the sale of "Stars" as in detail specified in business cooperation agreements.

Rights and Obligations of the Client:

 

• The Client is entitled to any information arising from the established relationship with the Company.
• The Client must provide necessary data and documentation as required by the Company's regulations.
• The Client is solely responsible for any taxes and related fiscal obligations arising from the sale of the digital product "Stars."

Liability for Damages:

 

• In case of damages due to breach of contractual obligations by either party, the responsible party must compensate for the damages.

Personal Data Protection:

 

• The Client's personal data is protected and stored in accordance with relevant laws.
• The Company collects and processes personal data based on the Client's consent or legal authorization.
• Personal data will be used for contract fulfillment, marketing, and promotional activities. The Company will take appropriate measures to protect personal data from unauthorized access, alteration, destruction, or loss.

Advertising General Terms of Business:

 

• The Company must advertise these terms clearly and understandably, providing necessary information for the Client's decision - making.

Jurisdiction of the Court:

 

• Disputes that cannot be resolved amicably will be handled by the court at the Company's headquarters unless otherwise specified by law.

Publication Method:

 

• The Company publishes these terms and any amendments on its website at least 15 days before they take effect.

Effective Date:

 

• These General Terms come into effect 15 days from the date of publication on the Company's website.
